I was just clarifying your statement. I understand your position on safety and don't disagree. As to your assertion about the law, well..... I'll let that one go.

I’ve often wondered if someone were to lose their trailer and someone got hurt due to no safety brakes if online comments like these would be evidence of negligence.

A good lawyer would bring in all the evidence he/she could. But most often would go after the responsible partys with the deepest pockets. Ie
* The hitch manufacturer
* The hitch installer
* The Auto manufacture
* The trailer manufacturer

The list goes on.
