And don't forget criminal and civil courts have different burdens of proof, with the latter having a much lower bar. Further, you have to violate a law to have criminal culpability. There is no such requirement in civil court.

I’ve often wondered if someone were to lose their trailer and someone got hurt due to no safety brakes if online comments like these would be evidence of negligence.

A good lawyer would bring in all the evidence he/she could. But most often would go after the responsible partys with the deepest pockets. Ie
* The hitch manufacturer
* The hitch installer
* The Auto manufacture
* The trailer manufacturer

The list goes on.
