Default HoA Woes

So, I was hoping you all might be able to help brainstorm remedies to the predicament I find myself in:

I received a letter from my HoA advising that my TM is not compliant with the CCC&Rs and that I had 10 days to remove my trailer. Perplexing to me is the fact that (except for the 2 months it was at Custom RV) it as been on the side of my house for 2 years. My previous camper (a popup) had been on the side of the house for 9 years prior to that, without a peep from the HoA. Both trailers were visible from the fence, but only the AC unit (rest of trailer is below the fence line).

My experience is the HOA has a complaint from a neighbor. For the previous years, may not have had a complaint.

Or.. The HOA has changed the Restrictions.

Or... There is another neighbor that has created a violation and now the HOA has to make sure everyone complies.

I can't see a good solution going forward. My personal experiences with an HOA are not suitable to share in a public forum.

Taller fence or plant a tree ? Option would be to store at a storage facility. Maybe talk with the hoa and see what your options are.

Move to a new house without an HOA? 😜😎 My father in-law has shared some real nightmare stories about HOAs but the one he deals with in southern FL seems to be a pretty sweet deal. I have no personal experience...

In what way, actually, are you not compliant? What specifically did they quote as the regulation you were not compliant with, and in what way are you not compliant? It's hard to come up with ideas when we don't know the specific problem.

I think this is key. A friend of mine once received a ticket from a water police officer for standing in his powerboat boat while it was underway. It was a hefty fine. However, when we actually looked up the statute for what he was cited for violating, it read something to the effect of "pilot must operate the watercraft in the way in which it was designed and intended by the manufacturer." So, we pulled up the manufacturer's brochure of the the powerboat in question, which had a picture of someone standing while piloting the boat, arguing that clearly the manufacturer had intended for the pilot to stand while the boat was underway.

Case dismissed.

That being said, the HOA could then simply change the rules to make it clear you are in noncompliance.

Get a copy of the CCCR's. Read them for yourself. Know what your rights are and what it is they are referring to. Attend the HOA board meetings.

Yes, but often, they must grandfather people. It becomes a nightmare for them to enforce new rules when they are clearly singling out specific residents.....

Hi Holly,

I thought I had addressed this in my post, but it was late, err early (hadn't been to bed yet) when I submitted it. the issue is that some part of my trailer (the AC unit) is visible from the street (per the picture included in the letter of infraction).

Thank you all for your input. I was incredibly tired this morning (have not yet gone to bed) and was venting. I am exceedingly frustrated that it has now become an issue, though I will admit, I likely don't have a leg to stand on. I signed the CCC&Rs when we closed on the house (in 2003) and knew what they said. both trailers were visible from the street (or at least a portion of them -the AC unit was/is). It was a gamble I had taken for 11 years, and one I've now (probably) lost.

As for what to do: In the interim, I am going to store (temporarily) the camper at my Aunt's house. She indicated that this was a short-term option (3-6 months). Regarding the plant a tree suggestion: great idea...good for the environment... likely not feasible in my situation. Moving is my idea, just not ready for that. The wife said sell... |sad face|.
